Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Berl View website or engaging our services. By accessing view.berl.dev or entering into a service agreement with us, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. About Berl View

Berl View provides spatial mapping, digital twin creation, and immersive 3D visualisation services for the real estate and hospitality sectors. Our registered address is No 280/A-3, Madapatha Road, Piliyandala, Sri Lanka.

2. Services

Our services include on-site spatial scanning, digital twin rendering, browser-native delivery, and hosting of interactive 3D environments ("the Twin"). The specific scope, timeline, and deliverables for each project will be agreed in a separate written service agreement or proposal.

3. Client Responsibilities

To enable us to deliver our services, you agree to:

  • Provide accurate information about your space and requirements.
  • Ensure our capture team has lawful access to the property on agreed dates.
  • Obtain any necessary permissions from third parties (e.g. landlords, local authorities) before we scan the space.
  • Review and approve deliverables within the timeframes specified in your service agreement.

4. Payment

Fees and payment terms are set out in your individual service agreement or invoice. Unless otherwise agreed:

  • A deposit may be required before work commences.
  • Final payment is due upon delivery of the completed Twin.
  • Late payments may incur interest at a rate of 1.5% per month on the outstanding balance.

5. Intellectual Property

Your content: You retain ownership of all property data, images, and materials you provide to us. You grant Berl View a limited licence to use this content solely for the purpose of delivering your project.

Our deliverables: Upon receipt of full payment, you are granted a non-exclusive, non-transferable licence to use the completed Twin for the purposes described in your service agreement. The underlying technology, rendering pipelines, and software frameworks remain the property of Berl View.

Portfolio use: Unless you opt out in writing, we reserve the right to feature your completed Twin in our portfolio, marketing materials, and social media for the purpose of demonstrating our work.

6. Hosting and Availability

Standard hosting is included for 12 months from the date of delivery. We aim to maintain 99% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. Hosting renewals are available on annual plans agreed separately.

7. Limitation of Liability

To the fullest extent permitted by law, Berl View's total liability for any claim arising out of or in connection with our services shall not exceed the total fees paid by you for the specific project giving rise to the claim. We are not liable for:

  • Indirect, incidental, or consequential losses.
  • Loss of revenue, profit, or data.
  • Delays caused by factors outside our reasonable control (force majeure).

8. Warranties and Disclaimer

We warrant that our services will be performed with reasonable skill and care. All other warranties, express or implied, are excluded to the extent permitted by law. Digital twins are representations of a space at the time of capture; we make no warranty that a Twin will reflect subsequent changes to the physical space.

9. Cancellation and Termination

  • Client cancellation: If you cancel a project after work has commenced, you will be invoiced for work completed to the date of cancellation. Deposits are non-refundable.
  • Berl View cancellation: We reserve the right to terminate a project if you are in material breach of these Terms. In such cases, fees for work completed will remain due.

10. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of a project and not to disclose it to third parties without prior written consent, except as required by law.

11. Governing Law

These Terms are governed by the laws of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
